Within 6 months mine had failed, car stuttering and lag under acceleration, dealer diagnosed failed EGR. So I called their bluff and said fine you checked it and within 6 months it fails, so BMW agreed foc replacement. My understanding is that the EGR on our model year was a problem, mind was replaced with modified version.

I've read that having EGR actually improves fuel economy and a working EGR valve is supposed to be shut at WOT so in theory it doesn't hurt performance either.
The EGR valve is normally closed. There is no EGR flow when the engine is cold, at idle, or during hard acceleration. The EGR flow is at its peak during steady cruising under moderate load. In some cars, the EGR valve is operated by a vacuum actuator, as in the first diagram below. Modern cars have an electric EGR valve with a step motor.

The repair tech at BMW said it happens enough that BMW issued a TSB (technical service bulletin) to all the dealerships so they know how to troubleshoot and assess damage. Based on that TSB, the tech recommended I replace the EGR valve, EGR cooler, throttle body, particulate filter, etc, etc. The entire list of parts totaled $6500.
